gregation as a Lay Delegate; that he is a Lay member of such Church or Congregation, and has been such member for at least twelve months next preceding the time of his appointment, and that the election was held in accordance with all the requirements of the Canons.

(IV.) No other certificate or evidence of appointment of any Lay Delegate than such as is above required shall be allowed or received.

SEC. 8. No Lay Delegate from a Church having a Vestry shall be entitled to a seat in the Convention unless he be entitled to vote for Wardens and Vestrymen of the Church which he is appointed to represent.

SEC. 9. A copy of the seventh and eighth sections of this Canon shall be transmitted annually by the Secretary of the Convention to every Church in this Diocese in union with the Convention, together with a blank printed form of certificate of appointment of Lay Delegates, and the notice which he is required by the Constitution to give of the time and place appointed for the meeting of the succeeding Convention.

SEC. 10. It shall be the duty of the Clerks of the Vestries of the Parishes which have been admitted into union with this Convention, immediately after the appointment of the Lay Delegates to the Diocesan Convention, to certify their election to the Secretary of the Convention in the form prescribed by Sections 7 and 8 of this Canon. From the certificates thus received the Secretary shall prepare a list of Lay Delegates for use in the organization of the Convention.

SEC. 11. The presence of at least fifty Clergymen entitled to vote in the Convention, and of Delegates from at least forty congregations, shall be necessary to the transaction of businessexcept that a smaller number may adjourn from day to day.

SEC. 12. If the President ex-officio of the Convention is not present at its opening, the Secretary of the Convention shall call to order the members present, when the senior presbyter present entitled to a seat in the Convention shall take the chair, and shall preside until a President be elected, as provided by Article V. of the Constitution.

SEC. 13. The Secretary of the Convention, under the direction of the Bishop, or, in case of his absence or inability to act, or of a vacancy in the Episcopate, under the direction of the Standing Committee, shall call over the names of the Clergy entitled to seats.

SEC. 14. He shall call the names of the Lay Delegates whose election has been certified to him, in pursuance of Section 10 of this Canon. The President shall then appoint a committee of three persons, to whom shall be referred the credentials of the Lay Delegates, who shall report upon the correctness of the roll made by the Secretary.

SEC. 15. The calling of the names of the Clergy entitled to seats and of the Lay Delegates may be dispensed with by a unanimous vote of the members of the Convention present, provided that evidence satisfactory to the Convention of the presence of a canonical quorum of each order be laid before the Convention by the Secretary. In such case the Secretary shall take means to secure a correct list of the Clergy entitled to seats and of the Lay Delegates who are present at the Convention.

SEC. 16. A quorum, which shall consist of fifty Clergymen and Delegates from forty Congregations, being present, the President, ex-officio, if present, shall declare the Convention duly organized. If he be absent, or unable to act, the temporary President shall direct that the members proceed to vote for a President as provided in Article V. of the Constitution, which election shall be by ballot, unless dispensed with by the unanimous vote of the members present. The President, being elected, shall declare the Convention organized for business.

SEC. 17. The Convention shall then proceed to the election of a Secretary and Treasurer of the Convention, by ballot, unless dispensed with by the unanimous vote of the members present. The Secretary shall appoint two assistants, and announce their names to the Convention.

SEC. 18. The existing Rules of Order, so far as they are applicable to the preliminary proceedings for the organization of the Convention, shall be deemed in force for that purpose; and

the said Rules of Order, except such of them as prescribe the mode of altering the same, shall regulate the proceedings after the organization, until altered by the Convention.

CANON III.

Of the Call of the Convention.

Unless it be otherwise directed by the Convention, the mode of giving notice of the meeting of any Convention, shall be by an advertisement of the time and place of such meeting, signed by the Secretary, and published in three of the public papers, or Church journals, printed in the Diocese of New York. Whenever, under the provisions of the Constitution, a Special Convention is called for any particular purpose, it shall be the duty of the Secretary, in the notice thereof, to specify such purpose.

CANON IV.

Of the Admission of a Church as a Parish into Union with the Church in this Diocese and Maintaining such Union.

SEC. 1. Every Church or Congregation desiring admission as a Parish into union with the Church in this Diocese shall present a written application therefor to the Convention, together with a copy of the Resolution of the Vestry or of the Congregation authorizing such application; in which resolution the said Church, by its Vestry or Congregation, shall agree to abide by, and conform to and observe all the Canons of the Church, and all the rules, orders, and regulations of the Convention, and to pay its Rector, so long as it shall remain in union with the Convention, in regular monthly or quarterly installments, a salary of not less than $1,500 per annum, or a salary of not less than $1,200 per annum and to provide for him a suitable residence, or a reasonable allowance in lieu thereof; which copy shall be duly certified by the presiding officer of the Vestry, or of the meeting of the Congregation at which the resolution was adopted, and also by the Clerk of the Vestry or Secretary of the meeting; and shall be authenticated by the seal of the corporation.

The said application shall also be accompanied by the Certificate of Incorporation of the Church, duly recorded, or a copy thereof, certified by the officer whose duty it may be to record

or to file the same; and also by a Certificate of the Bishop, or, in case of his absence, or of his inability or disability to act, or of a vacancy in the Episcopate, of the Standing Committee, that he or they approve of the Incorporation of said Church, and that such Church, in his or their judgment, is duly established; and also, by a certificate executed by the authority of the Vestry or of the meeting, authenticated by the seal of the corporation, to the effect that such Church or Congregation is willing and able among its own members to raise at least $1,500 per annum for the salary of its Rector, or to raise at least $1,200 for his salary and to provide for him a suitable residence or a reasonable allowance in lieu thereof.

Every Church or Congregation applying for admission shall produce satisfactory evidence that not less than twenty-five persons, members of such Church, have habitually, for at least one year preceding such application, attended divine service in such Church or Congregation.

The Certificate of Incorporation of every Church incorporated under any Act of the Legislature of the State of New York, save the General Act of April 5, 1813, and the Amendments thereto, shall declare upon its face that the Church or Congregation is a Protestant Episcopal Church, and that it is forever to continue such, in communion with the Protestant Episcopal Church in the State of New York; and it shall be the duty of the Secretary of the Convention to prepare and furnish blanks for the Certificate of Incorporation of Parishes, which shall embody the above provision.

SEC. 2. (I.) No application for the admission of a Parish into union with the Church in this Diocese shall be considered or acted upon at any meeting of the Convention, unless the same has been transmitted to the Secretary of the Convention at least forty days before the meeting of the Convention.

(II.) It shall be the duty of the Secretary of the Convention, at least thirty days before the meeting of the Convention, to deliver to a Committee, to be annually appointed (to be called the Committee on the Incorporation and Admission of Churches), all applications for admission into union which shall have been received by him, to be by such Committee examined, considered and reported upon to the Convention.

SEC. 3. Whenever any Parish in union with this Convention shall neglect for three years in succession to make a Parochial Report, no missionary report being made on its behalf, and shall not, during the same period, have employed a Clergyman as its Parish Minister, nor requested of the ecclesiastical authority to have the services of a Missionary, such Parish shall be regarded as having forfeited its connection with the Convention, and shall no longer have a right to send a Delegate or Delegates to the

same.

The Bishop shall report such Parish to the Convention in his. Annual Address.

Such Parish, however, may be re-admitted, upon application to the Convention, accompanied by a report of its condition, and on such terms as shall appear just; such re-admission to take effect from and after the rising of the Convention consenting to such admission.

CANON V.

Of the Secretary of the Convention.

SEC. 1. In addition to the constitutional provisions concerning the Secretary, it is hereby declared that this officer shall be chosen by ballot after viva voce nominations of the Candidates, and shall continue in office until a new election is made.

SEC. 2. He shall transmit annually to each of the Bishops of the Protestant Episcopal Church in the United States, and to the Secretary of the last House of Clerical and Lay Deputies in the General Convention, and to the Secretary of every Diocesan Convention, a copy of the Journal of the Convention; and shall request the last to send copies of their respective Journals in exchange.

SEC. 3. He shall also transmit to every General Convention in addition to the documents mentioned in the Canons of the General Convention, a certificate, to be signed by himself, containing a list of the Clergymen in this Diocese, and the amount of funds paid or secured to be paid (distinguishing them) to the General Theological Seminary, together with the nomination of Trustees of that Seminary; and also a like certificate of the appointment of Clerical and Lay Deputies.
